For the purpose of Queensland’s bilateral agreement with the Commonwealth of Australia under the Environment Protection and Biodiversity Conservation Act 1999 (Cth), it was necessary to amend Queensland planning legislation to introduce an EIS process. This does not fit well with Queensland’s broader approach to upfront planning for an area and Queensland’s more holistic approach to development assessment. (Note that some of the anomalies referred to in this paper have been removed by amending legislation, since the date of this paper.)
